Former Chief Judge Kaye to investigate Paterson cases

ALBANY – Attorney General Andrew Cuomo has recused himself from the investigation into possible misconduct on the part of Governor David Paterson. He has appointed retired Chief Judge Judith Kaye as a special prosecutor.

One case involves a domestic violence case involving the governor’s aide, David Johnson, and the case of receiving Yankees World Series tickets.

Cuomo said his office has conducted preliminary investigations into both cases and believes there are “credible issues” that need to be addressed.

Cuomo, who will likely announce he will run for governor in the fall on the Democratic line, said he was concentrating on the cases before his office and would make an announcement about his political future later in the year.

But, he said he wanted to be sure that in New York’s political climate, there was no appearance of impropriety.

Judge Kaye, who has agreed to serve pro bono, will have full powers to conduct her investigation as she sees fit.

Paterson has announced he will not seek election in November.
